Talent Linx (hereinafter referred to as "Talent Linx") is a specialized recruitment and placement consultancy focused on the long-term career support of Candidates and their placement with Companies. These Terms of Use establish the contractual agreements between Talent Linx and the Candidate.
§ 1 Definitions
The terms used in these Terms of Use have the following meanings:
- Candidates: Individuals who have registered with Talent Linx or applied for a position at a Company.
- Companies: Businesses from various economic sectors that have entered into recruitment service agreements with Talent Linx.
- Positions: Vacancies to be filled within Companies, ranging from specialist and expert roles to executive and leadership positions.
- Placement: The establishment of contact between Candidates and Companies with the aim of enabling employment. The placement ends as soon as a contract between the Candidate and the Company is concluded or rejected.
- Professional Consulting: The ongoing support and advisory provided to Candidates to clarify career goals and develop suitable placement options.
§ 2 Scope of Services and Subject of Cooperation
The services offered by Talent Linx are directed exclusively at individuals seeking permanent employment at a Company. Talent Linx commits to supporting both the Candidate and the Company in achieving a successful placement. The services offered are provided on a voluntary basis and include the following areas:
- Professional Consulting: Review of application documents, discussion of career goals, and advisory regarding potential job options. Talent Linx also conducts labor market analyses and builds relationships with relevant Companies.
- Placement Service: Support in applying for recommended Positions, including the creation and anonymized forwarding of application documents to Companies. Candidates are kept informed of the application status and can decide whether they wish to have their full application documents forwarded.
- No Entitlement to Services: There is no legal entitlement to receive job offers, the forwarding of application documents, or specific information.
§ 3 Conclusion of Contract
- The contract may be concluded either via the Talent Linx website or by email.
- Before submitting the contractual offer, Candidates have the opportunity to review and, if necessary, correct their information. Upon successful conclusion of the contract, Candidates will receive a confirmation via email.
§ 4 Obligations of the Candidate
Candidates have the following obligations:
- Duty to Cooperate: Provision of truthful application documents, including a tabular curriculum vitae (CV).
- Duty to Inform: Notification of any contract concluded with a Company, including details regarding the agreed remuneration upon request.
- Confidentiality Obligations: Confidential information, particularly regarding Companies and contact persons, must not be disclosed to third parties or used for direct applications bypassing Talent Linx (non-circumvention).
§ 5 Remuneration, Commission, Travel Expenses
The services provided by Talent Linx are free of charge for Candidates. Travel expenses for interviews at Companies will not be reimbursed by Talent Linx.
§ 6 Term and Termination of Contract
The contract may be terminated at any time without notice. However, Candidates commit to informing Talent Linx of any contract conclusion with a Company within 24 months following a successful introduction/placement.
§ 7 Liability
Talent Linx is fully liable for damages caused intentionally or through gross negligence, in cases of injury to life, body, or health, and in accordance with the provisions of the Product Liability Act. In all other cases, liability is limited to foreseeable, contract-typical damages.
